Constable gives tips for removing home occupiers

Phoenix – Protecting your home from home -occupiers can be as easy as ensuring that your house looks like someone is living in it.

But sometimes that's not enough.

Scott Blake County County County concluded that Chris and Joe Show in Ktar News 92.3 FM Monday to discuss the processes of the removal of home occupiers from a property.

So what do you do if you find that a person has entered your house illegally?

The first step, said Blake, is to call 911 and local authorities that the person can arrest for violation. Both in Arizona are illegal in Arizona, but some may have rights.

If this person is able to conclude a rental agreement, the problem changes from a criminal to a civilian.

“If you give a rental agreement for some reason, it will start the evacuation process,” said Blake.

“In general, you have printed out a rental agreement and sign yourself and sign another party on behalf of the homeowner or real estate manager,” he added. “And if this is made for law enforcement, you will withdraw and it will become a civil law problem in which you have to submit to the citizens.”

How to start the evacuation process to remove the house -occupier

If a person is illegally entering their house and is able to create a rental contract to create what is likely to be fraudulent-the homeowner must be an announcement of five days to leave the house within this period.

If this is not the case, the case escalates to the civil court, where the homeowner submits a summon and a complaint that is delivered by a Constable or a process server.

“In the following week you will have a legal proceedings and then you can prove that you do not have a rental agreement, and then the letter will receive a police officer or a civil representative five days later to facilitate evacuation,” said Blake.

“The system has to work on and show that they never had the rental agreement so that they can turn around and follow them again,” he added.

Overall, Blake found that the evacuation process would take 21 days.

How to protect your home from home occupiers or title fraud

A common way, how house applicants can terrorize homeowners is title fraud if you steal or forge the title of a property without the knowledge or approval of the owner.

Maricopa County has a target page for title fraud that can be accessed here. The free program monitors and alerts subscribers when documents are recorded under their name.

Other options for how homeowners can protect their home, install security systems and motion sensor lights inside and outside the house, said Blake.

He also asked home owners to invest in a doorbell camera and ask their neighbors to keep an eye on their house when they have been gone for a long time.
