Press release: Pecatonica township and candidates receive a lawsuit against city clerk Kelly Olson-Fuca

On March 10, 2025, the district of Winnebago County, Lisa Fabiano, decided in favor of Pecatonica Township, the election campaign by the Pecatonica Township Officers and the candidates Gregory Deppe and Thomas Müb in their complaint against the municipality of Clerk Kelly Olson-Fuca. Another candidate for the municipality of Faithänder, Brian Boomer, submitted his receipt with his nomination papers if necessary.

On January 30, 2025, the city clerk Kelly Olson Fuca published a changed vocal certification to the Winnebago County Clerk, who removed her father's opponent, Gregory Deppe, and the incumbent Highway Commissioner Thomas Menge from the ballot paper to insert the receipt with her office. However, she did not remove her father or other two candidates who did not submit her receipts with her office. She simply removed her political enemies on the ballot.

Olson-Fuca refused to comply with two decisions of the election board to instruct them to certify Deppe and quantity for the ballot paper, even though she voted as a member of the election committee for the decisions and signed it. In the decision about the case on Monday, Chief Judge Lisa Fabiano explained that Olson-Fuca “arbitrarily and violated the petent's equal rights against a conformity test and at the same time the petitions of other candidates, including itself, undertook the same misfirepings.” The judge found that this is “clearly a violation of the balance of the amount and fools of the same property rights. Judge Fabiano found that Olson-Fuca's argument was “faulty” and that “her argument that she can violate the arrangement because she thinks it is incredibly wrong.” After Olson Fuca had “exceeded her authority” and “arbitrarily acted in the decertification of quantity and Deppe”, the court ordered Olson-Fuca to restore them in the ballot papers.

Gregory Deppe runs for Pecatonica Township Supervisor. Thomas Menge is the incumbent motorway officer who runs for re -election. The candidates Deppe and quantity were represented by lawyer Rodney Kimes. The municipality was represented by Keri-Lyn J. Krafthefer by Ancel Glink. The rest of the cases continued for further procedures by April 23, 2025. The employee's measures have caused the municipality at considerable legal costs. In the lawsuit, Olson Fuca will also pay the municipality's legal fees. Olson Fuca tries to pay the municipality's insurer their legal fees.
