Despite the absence, OSP can file criminal charges against Offori -Antta – Martin Kpebu


The private law practitioner Martin Kpebu has claimed that the office of special prosecutor (OSP) can still act against the former finance minister Ken Ofori-Ata, even if he refuses to appear as a survey.

According to him, the courts generally have to oblige a suspect to meet with investigators, but the courts can make an exception to ensure that justice is served.

“To be clear, he has to meet, he has to meet [with the OSP]. But if he doesn't do it, I can also imagine that our dish will make an exception in the event. Because if you don't, this means that all five cases cannot go on against him. The law doesn't work that way, “said Kpebu.

The legal expert also referred to a precedent in the case of ACP Dr. Benjamin Agordo, in which the dishes, despite the refusal of the suspects, continued to make statements.

“So if OFORI-ATTA is said to write his indictment and he rejects, the court will be able to continue,” added Kpebu.

His comments come in response to concerns about operating Attas non-compliance with the OSP guidelines in relation to ongoing investigations into financial mismanagement and corruption allegations during his term as finance minister.

In the meantime, the OSP has issued a warning to Ken OFORI-ATTA and explained that it would be newly stated as a person sought if he did not appear for the survey on June 2, 2025.

A member of the legal team of Ken Ofori-Ata, Frank Davies, questioned the motive of the OSP in the treatment of the case.

Mr. Davies questioned the existence of the special prosecutor in the publication of the matter when an agreement was already available in June that OFORI-Ata was published.

He also argued that the reasons from OFORI-ATTA, to be outside the country, had been properly communicated via official channels and asked why the OSP would not wait for the agreed date.

“Our customer is still outside. Is he not outside for a certain reason? Was this reason not made known to the special prosecutor by exchanging correspondence? What else should he be done.
