The Criminal Code includes mandatory treatment of drug crimes, but “in special cases”

According to the executive secretary of the Georgian dream, the majority leader Mamuka Mdinaradze, the Criminal Code will contain mandatory treatment of drug crimes, but in special cases.

According to him, the judge will decide whether a person needs mandatory treatment.

“We have agreed that mandatory treatment should be included as a punishment in the penal code, but this will be in special cases and it will be a category of criminal punishment. This will not be an administrative penalty, it will be a punishment prescribed in the standard of criminal law.

In the event that a person is convicted of a drug break, possibly in special cases, they will be at the judge's discretion. It is also possible that the exercise of this discretion is based on the conclusion of a narcological examination together with the materials in the case, and the judge can decide that this would not only be imposed on private prevention, but also for general prevention, in order to impose this provision. This is another topic for discussion. We will continue to discuss this.

Even the precedent from Strasburg enables us to do this that a person represents a danger for themselves and for society and may need mandatory treatment. This decision can be made by the judge.

The law on marijuana is only tightened with regard to the sale, ”said Mdinaradze.
