Lawyers get involved in Tom Girardi Mental Health date – Daily News

By Fred Shuster

The lawyers are fighting when they are supposed to hear a hearing in the city center of Los Angeles about the results of Tom Girardi's recent six -week psychological health assessment in a federal medical facility of Tom Girardi.

The outstanding former lawyer spent about 45 days at FMC Butner, a federal prison in North Carolina for male inmates who have special health needs to determine Girardi's true degree of cognitive impairment before being convicted

The public prosecutor's office of the US law firm wishes that the hearing will be held in LA at the latest on April 11, but the Girardi's lawyers reject the government's proposed date and instead urge May 16, as documents show.

The evaluation of mental health was ordered by the US district judge Josephine L. Staton to determine whether the 85-year-old defendant for the rest of his life after August 2024 should be admitted to a nursing facility for prison or hospital due to convictions of four wire fraud.

The US prison office submitted its approximately 30-page evaluation by Girardi on March 11th. The report is “neither complex nor voluminous … and does not recommend any further tests or reviews of the accused,” wrote the deputy US lawyer Scott Paetty.

“The defendant had enough time to keep an expert to review and evaluate the BOP report,” the prosecutor wrote to support the date on April 11th.

Paetty stated that the public defender of Girardi's public defender Samuel Cross would like to have more time in order to contact the report with already set experts and to contact other potential experts and amateur witnesses.

Cross rejected a comment on Monday.

The staton is expected to set a conviction date in court after discussing mental health.

The judge ordered Girardi to send a defense application to Butner in December to investigate whether Girardi's symptoms of intellectual decline increase to the extent that the hospital stay is more suitable than a prison cell. The federal prosecutor recommend in a BOP judicial facility that offers suitable health services as soon as a “significant prison sentence” offers in a BOP prison system.

The government argues that there is no reasonable reason to believe that Girardi's mental illness requires hospital stays, the prosecutors wrote in additional convictions at the end of last year.

“The parties and the court agree that the defendant has some signs of cognitive impairment,” wrote the prosecutors about four months ago. “However, the court found on several occasions that the accused had signs of abuse and showed the ability to operate demanding behavior in order to exaggerate the symptoms of intellectual decline for its own benefit. As a result of this malinging, it is difficult to precisely determine the true impairment of the defendant. “

Girardi has been housed in the safe section “Memory Care of a supervised residential facility in Orange County in Orange County in contrast to a hospital”.

In former newspapers, the US law firm demanded that Girardi be sentenced to 14 years behind bars to steal millions of customers. The defense countered that the oddly lawyer is a “bankruptcy, half-blind, incontinent, 85-year-old man with dementia”, who instead should be placed in a closed medical facility for the rest of his life.

Once to the most successful and prominent lawyers in the country, Girardi should be convicted of the process that ended in his convictions in the city center of Los Angeles. The prosecutors claim that Girardi had stolen millions of customers and spent the money for private jets, golf club memberships, jewelry and the career of his now oriented wife, the former “Real Housewives of Beverly Hills” star Erika Jayne.

In a money judgment submitted by Staton on Friday about the realization submitted by Staton, the judge ordered that Girardi can be traced back for almost 3.8 million dollars because he had to protect the conviction of the “List fraud program against the injured clients he swore”.

Girardi's “years of theft of client funds from his law firm's trust accounts and the countless lies he said that he should cover up his theft, represent a calculated and devastating betrayal of people who turned to him in their darkest hour,” wrote the prosecutors.

Girardi was previously known as a defender of the powerless in class procedures against companies and represented the plaintiffs in a number of top -class cases, including Bryan Stows civil lawsuit against the Major League baseball. Stow was the San Francisco Giants fan, who suffered serious injuries during an attack in a parking lot of the Dodger Stadium.

Girardi also represented the plaintiffs in the poisonous groundwater case against Pacific Gas & Electric Co., who dramatized Julia Robert's film “Erin Brockovich” 2000 in the Oscar Award.

But this version of Girardi no longer exists, his lawyers say.

“He lost everything, from his owners to his reputation, to his head,” say defense work. “He spends his days in a Lockdown memory care facility, in which he occupies a common room and needs support for basic tasks around the clock. He has to be made to take a shower of the pretext, go to court, and spends his time to write pages with notes about imaginary legal cases and clients that do not exist. He does not remember the process or the judgment on this matter. “

Girardi's lawyers argue that a prison sentence is not necessary because his client is an octagonal first perpetrator who is convicted of non -violent crimes that are not ongoing or future threat to society.

The well -published criminal proceedings, the collapse of his law firm Girardi Keese, and the answer from the public prosecutor's office has made Girardi “a central parias” and a “warning story for lawyers nationwide”, wrote his lawyers.

“A prison sentence of the lifetime in a medical facility would be sufficient,” wrote the defense and asked the judge to reject the application of guidelines of the federal judgment.

Girardi was convicted in August 2024 because he operates the massive 10-year program, in which the public prosecutor's office of four of its customers had located at least $ 15 million in comparison funds. Girardi showed no visible reaction because the judgments were read before the Federal Supreme Court of Los Angeles. According to all reports, he suffers from a certain degree of dementia, but was able to support his own defense during the process, and he even said.

The former chief accountant of Girardi's law firm, Chris Kamon (51), formerly from Encino and Palos Verdes and who lived on the Bahamas at the time of his arrest from November 2022, said in October 2024 to enable two wire fraud to enable the company's pollution from the company.

Kamon is about to be convicted on April 11th.

Girardi, Kamon and David R. Lira, Girardi's son -in -law and former lawyer at Girardi Keese, are in Chicago with other allegations of federal fraud.

Last year Girardi was found to be competent after several days of hearing, although he claimed that he had Alzheimer's disease and was unable to support his lawyers. He was allowed to be free with a bond of 250,000 US dollars.

Girardi's alienated actress Ms. submitted a divorce after a 21-year marriage in November 2020. After the separation, the couple listed their house in Pasadena for sale at a price of $ 13 million. In that case, Jayne was not charged with her husband.
