Alabama's murder process of the police officer is brought to court, court rules

Montgomery, Ala. – The hearing of the immunity for a police officer in Alabama accused for murder will proceed in March, a judicial court decided that after not evidence that the official, the judge, who supervised the case, did not give up his intentions against him.

All five judges of the State Court of Appeal decided that the lawyers of the former Decatur Mac Marquette could not present a “affidavit or factual evidence” who had demonstrated that the judge of Alabama Circuit Court, Charles Elliot, had affected his integrity in the event. Marquette's lawyers submitted an appeal to the State Court of Appeal after Elliot denied her application that he was back.

Marquette is charged with murder for murder Marquette's lawyers said that Perkins had directed a weapon on the towing car driver, and that the officer should be granted the immunity according to “Stand Your Ground” setting, which remove the obligation to withdraw before using fatal violence.

A neighbor's home monitoring video broadcasts by Waff seems to show Marquette almost 20 times that Marquette fires his weapon. The shootout triggered an intensive public outcry and protests in the whole of Decatur, a city with around 60,000 people in the north of Alabama. Demonstrators and civil rights lawyers say that Marquette had given no time to follow his commands.

In a petition to the State Court of Appeal, Marquette's lawyers Elliot accused of improper communication outside of the official legal process several times, and called for a hearing to provide evidence of these allegations. In at least one case, Marquette's lawyers Elliot, the police department of Decatur, Mike Burleson, accused that he had already decided to refuse the Marquette immunity because of the top-class nature of the case and for fear of the safety of his family and the potential setbacks in his repeat campaign of 2026.

In the petition, a non -identified witness quoted Marquette to say that they have overheard the conversation.

In a written affidavit, Elliot said that the defenders had submitted the application for his withdrawal “ruthless and disregarding the truth”. He said he had a long -standing friendship with Burleson, but vehemently denied that the conversation had taken place.

In the repayment, Elliot also said to “intimidate” and “harass” a defender for a vacation outside of the official legal process. The Court of Appeal decided that Elliot was not inappropriate to call the defender because the call was procedural.

Marquette's lawyers did not respond on Tuesday morning to a request for comments controlled by e -mail. A call to Ellio's office was not returned.

The immunity negotiation begins on March 25th.
