A man from the Central Valley, who was convicted of crime 6 January 6th and pardoned by President Donald Trump, but was also found guilty for a separate weapon accusation, will be a free man today today.

A three-judge committee of the Circuit of Appeal's ninth Circuit Court ordered Benjamin Martin from Madera County to be released while he was appealing against his conviction. Troy Nunley, Supreme Judge of the Federal Court of the Eastern District, belongs to which Fresno, signed the decision on Wednesday.

“He is excited to be outside. We are pleased that the correction of the system corrects itself and this injustice is corrected, ”Nate Miller, family lawyer of Martin, told GV Wire.

“We are happy to have him back. The whole thing was a nightmare for his family. It was traumatic. It's been a long time. It was terrible to be in prison, ”said Miller.

The developments come six weeks after Martin put the federal authorities in Fresno himself.

Last June, a federal jury in Washington, DC, condemned him because of his role in the attack on the US capitol of two crimes and several offenses. The investigators accused Martin of keeping a door open while others entered.

The federal judge Jennifer Thurston, based in Fresno, also considered Martin to be guilty in September 2024 and came up with the FBI's examination of January 6th. Criminal prosecution officers found firearms in the security of Martin's house. Martin was previously convicted of domestic violence and was not allowed to have firearms.

Martin received 13 months for the crimes on January 6th and 38 months for the arms punishment. Trump pardoned all convicts on January 6th in one of his first office campaigns. However, the forgiveness did not apply to his weapon accusation.

The new lawyer ensures the publication

The Martin family hired the lawyer George Pallas based in Miami, who helped other customers to win the customer. He took over for the federal public defense lawyer who had represented Martin.

Pallas filed an appeal application on February 27 and argued that the pardon should also apply to the weapon fee.

The next day, the Court of Appeal Barry Silverman, Milan Smith Jr. and Bridget bathed the release of Martin with the same deposit conditions as in his process phase.

The appeals were appointed by President Bill Clinton, George W. Bush and Trump (during his first term).

“In view of the government's declaration and the request that this court of Martin's application for approval up to the complaint and the arrangement, it will be released from the BOP-right,” said the court file.

In a registration with the court, Michelle Beckwith said that her office had not rejected the application for release.

There is a significant question of law or the fact in terms of Martin's forgiveness that supports the publication until the appeal, ”wrote Beckwith and the deputy US lawyer Nirav Desai.

Nunley signed the decision on Wednesday after Thurston himself disqualified. In her order, Thurston has no reason for the reason.

Martin's weapon conviction remains in force. The court did not set a date for the appeal.
